THE SALE OF ALCOHOLIC PRODUCTS IS PROHIBITED TO MINORS.
Users of the site www.robertocipresso.it declare they are of legal age according to the applicable legislation. If there is no legislation in this regard, you must be at least 21 years old.
All public prices include VAT and do not include any taxes, duties, and charges applicable in the destination country of the products and/or services, if different from Italy. These costs, which vary from country to country, are borne by the Customer, who is responsible for checking the amount with the relevant customs authorities.
Legal Guarantee of Conformity:
Products purchased on www.robertocipresso.it are covered by the legal guarantee of conformity under Articles 128 et seq. of the Consumer Code.
The legal guarantee is valid for two years and must be claimed by the consumer within 2 months of discovering the defect.
Online Dispute Resolution:
Pursuant to European Union Regulation no. 524/2013, European consumers are informed that the European Commission has established an online platform that provides an alternative dispute resolution tool.
This tool can be used by European consumers to settle any dispute related to online sales contracts of goods and services in a non-judicial way. Therefore, if you are a Consumer residing in Europe, you can use this platform to resolve any dispute arising from an online contract concluded on this site. These General Conditions are governed by Italian law, as is each Sales Contract, and are subject to Italian jurisdiction. Any dispute relating to the General Conditions or Sales Contracts will fall under the jurisdiction of the consumer's place of residence or domicile.

In Case of Defective Goods:
In Case of Defective Goods:
- they can be returned to www.robertocipresso.it within 14 days of delivery.
- The shipping and packaging costs for the return are borne by the customer.
- The defective goods will be replaced or refunded (if out of stock) by Roberto Cipresso.
In Case of Damaged Shipment:
If you receive packages from Roberto Cipresso visibly damaged by the courier (broken packaging or visibly stained from wine leakage from broken bottles), you can proceed as follows:
- If there are multiple parcels, reject the damaged one to the sender and sign the courier’s receipt “With Reservation.” We will then take care of returning the damaged package and sending you a new one.
- If there is only one parcel, reject the shipment entirely. We will handle the return and resend the shipment.
In case the broken product is out of stock, you will be contacted for a possible replacement. If no replacement is available in our catalog, Roberto Cipresso will refund the amount paid. Any shipping costs for returning the damaged package and delivering the new one are entirely our responsibility.
Non-Conforming Wine:
Non-conforming wine refers to wines that exhibit characteristics different from the producer's quality standards. For example, but not limited to, the typical “cork taint” smell and taste, liquid leakage, or severely damaged labels during transport.
Non-conforming wine can be replaced, if still available, at no extra cost to the customer. If it is no longer available, the purchase amount will be refunded.
As soon as the customer identifies a potential non-conformity, they must report it via email to segreteria@robertocipresso.it within 24 months of purchase and no later than two months from discovering the defect. The report must include the order number, pick-up address, a description of each non-conforming bottle, and the quantity.
Roberto Cipresso will then arrange for a free pickup via courier to the address provided.
The product(s) must be returned with at least 2/3 of the original content and sealed with the original cork, properly trimmed. The return package must use the original packaging to ensure safe transport. This procedure is necessary for Roberto Cipresso to be reimbursed by the producer or rightful party.
Once the wine is returned and the non-conformity is verified, new bottles of the same type and vintage (if available) will be sent or the amount paid will be refunded.
The process involves minimal bureaucracy and is completely free for the customer.
In case of dispute, the bottles remain available at Roberto Cipresso for further legal examination, and the customer will bear the return courier costs.
Right of Withdrawal:

Purchases on the site www.robertocipresso.it are subject to Legislative Decree 206/2005 and Legislative Decree 21/2014, which guarantees the right to withdraw from the purchase contract for any reason.
Conditions of the Right of Withdrawal (as per Legislative Decree 206/2005 amended by Legislative Decree 21/2014)
You have the right to withdraw from the contract without giving any reason within 14 days. The withdrawal period expires after 14 days from the day you receive the goods or a third party designated by you (other than the carrier) receives them.
How to Withdraw
To exercise your right of withdrawal, you must inform us of your decision by an explicit declaration, such as a letter sent by email to segreteria@robertocipresso.it or by post to ROBERTO CIPRESSO - Località Bivio dell'Asso, 53024 Montalcino (SI).
To comply with the withdrawal deadline, it is sufficient for you to send the notice before the 14-day period expires.
Effects of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs arising from your choice of a delivery method other than the least expensive standard delivery), without undue delay and in any event within 14 days of us being informed of your decision. The refund may be withheld beyond 14 days only until you have provided proof of returning the goods or until we have received them—whichever comes first.
Refunds will be made using the same payment method used for the original transaction unless otherwise expressly agreed. In any case, you will not incur any fees for the refund. The refund may be withheld until receipt of the goods or proof of return.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.
Please return the goods to us without undue delay and in any event within 14 days from the day you notified us of your withdrawal. The deadline is met if you send the goods before the period expires.

The item must be substantially intact; we recommend carefully packing the item, ideally using the original packaging.
Exclusions from Withdrawal
The right of withdrawal is excluded in the following cases provided for by Article 59 of the Consumer Code:
- the supply of goods made to the consumer’s specifications or clearly personalized;
- the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
- the supply of goods which, after delivery, are inseparably mixed with other items;
- the supply of alcoholic beverages whose price was agreed upon at the time of concluding the sales contract, whose delivery can only take place after thirty days, and whose actual value depends on market fluctuations that cannot be controlled by the professional.
